Artificial intelligence notice

Transparency information and terms of use of the POSITROM AI system. Last updated: October 2026. This English version is provided for convenience; in case of discrepancy, the Spanish version prevails.

1. Purpose and transparency

When you use the POSITROM chat, you are interacting with an artificial intelligence system, not a person. This notice is issued under the transparency obligations of Regulation (EU) 2024/1689 (AI Act), in particular article 50, and complements the legal notice, the privacy policy, the cookie policy and the terms.

2. Provider and system

• Service provider: Black Mamba Systems SL, https://positrom.com, email info@positrom.com.
• System name: POSITROM (subscription chat).
• Type: general-purpose AI system used as a conversational chatbot, available during the free trial or with an active subscription.
• Underlying model: the chat connects to a high-capability language model from a third-party provider, selected by the provider. Users do not choose the internal model.

3. What the system is and is not

POSITROM generates text from your messages and the conversation context. It is a general assistant. It is not:

• a high-risk AI system under the AI Act annexes;
• an automated decision-making system with legal or similarly significant effects on you (art. 22 GDPR);
• a licensed professional or a substitute for medical, legal, tax, financial, safety or engineering advice;
• a verified source of truth.

4. Technical limitations

Language models can invent data, quotes, rules, prices or references; be out of date; reproduce biases; misunderstand your question; or give incomplete or unsafe instructions. A fluent answer is not necessarily correct, complete or applicable to your case.

5. Human oversight

You are the human supervisor of every output. Before using it, review it, check it against reliable sources and, where appropriate, a qualified professional. Do not present generated text as human-written where the law or good faith requires disclosing its automated origin.

The provider may review conversations in case of abuse, security issues, complaints or legal obligations, and may limit or pause the service if the included usage runs out or these conditions are breached.

6. Prohibited uses

• committing or facilitating crimes, fraud, harassment, threats or impersonation;
• generating or exchanging child sexual abuse material;
• generating nudity or sexual, erotic or pornographic content (text or images), or any content that sexualises, eroticises or harms minors (see terms, section 7.1);
• designing or improving weapons, explosives or dangerous biological or chemical agents;
• cyberattacks or unauthorised access to systems or data;
• biometric identification or profiling prohibited by the AI Act or the GDPR;
• deceptive deepfakes or synthetic content without labelling where required;
• processing special categories of third-party data without a legal basis;
• circumventing usage limits, sharing the account, creating several accounts for extra trials or mass extraction of the system.

Breaches may lead to account suspension, subscription cancellation and, where appropriate, notification to the authorities.

7. Your responsibility for prompts and outputs

You are responsible for what you write and how you use the answers. Do not enter third-party secrets, unnecessary personal data of others or classified information. To the extent permitted by law, Black Mamba Systems SL is not liable for damages arising from a model output, except for wilful misconduct or gross negligence in providing access to the service. Consumer rights are always respected.

8. Personal data and model providers

Messages, conversation history, usage measurement and the account identifier are processed to provide the service, manage included usage and prevent abuse (art. 6.1.b and 6.1.f GDPR). To generate each answer, the text and necessary context are sent to the model provider, which acts as a processor. International transfers may occur under the safeguards of Chapter V of the GDPR.

POSITROM does not use your conversations to train its own model. The model provider may keep technical logs under its own policy. Do not send data you do not want an AI processor to receive.

9. Conversation retention

Conversations are kept while the account is active so you can pick up where you left off and to manage included usage. After closure, they are deleted or anonymised within a reasonable time. You can request deletion at info@positrom.com.

10. Ownership of outputs

You keep, as far as the law allows, the rights to the text you enter. For generated text, the provider grants you a licence for your lawful purposes, without guaranteeing it is free from third-party rights. You acquire no rights over the model, the brands or the POSITROM software.

11. Usage limits and availability

The free trial includes 300,000 free tokens for 30 days; when it ends, the chat stops until you subscribe. The €12/month plan includes generous monthly usage; if it runs out, the chat pauses until the next renewal, with no extra charges. Uninterrupted availability or a fixed number of words is not guaranteed.

12. Incidents and complaints

Report unlawful outputs or security incidents to info@positrom.com. You can also complain to the AEPD, the competent AI market surveillance authority in Spain, or use the EU ODR platform: https://ec.europa.eu/consumers/odr.

13. Minors

The chat and subscription are reserved for people aged 18 or over.

14. Acceptance

By registering, subscribing or using the chat you confirm you have read this notice, that you are an adult and that you will supervise the outputs. If you do not agree, do not use the chat.
