2. Purpose

This legal notice governs access to and use of positrom.com, user registration, the free trial, the monthly subscription, payment through Mollie and the use of the POSITROM artificial intelligence chat.

Accessing the site implies acceptance of this notice, the privacy policy, the cookie policy, the subscription terms and the AI notice.

3. Conditions of access and use

Users agree to use the site diligently, correctly and lawfully. In particular, it is forbidden to:

• use the site for unlawful purposes or to harm the rights of others;
• try to access restricted areas or break security measures;
• introduce or spread viruses, malware or any harmful code;
• reproduce, distribute or publicly communicate site content without authorisation;
• impersonate another person or provide false information when registering or for invoicing;
• create several accounts to obtain more than one free trial;
• share the account or resell access to the subscription.

The service is intended for people aged 18 or over.

4. Online contracting

When creating an account, users receive a 30-day free trial with 300,000 free tokens, with no payment details and no automatic charge. Only one trial is granted per person and email address.

The POSITROM subscription is a single plan at €12 per month, renewed automatically through Mollie. The paid contract is concluded when the first payment is confirmed. Before paying, users can review the price, interval and conditions on the subscription page.

Registration only requires an email address and a password. Billing details (name or company name, tax ID and address) are requested only when subscribing, in order to issue the invoice.

5. Intellectual and industrial property

The POSITROM brand, emblem, visual design, commercial texts, platform code and other site content belong to Black Mamba Systems SL or to third parties who have authorised their use, and are protected by Spanish and international law. Access to the chat does not grant any rights over the software or the brand.

6. Third-party services

The site relies on third-party services that are essential to its operation, including the Mollie payment platform and the provider of the AI model. These services are governed by their own terms. POSITROM is not responsible for the content of external sites linked from this one.

7. Disclaimer

We strive to keep the service available and the information up to date, but we do not guarantee the absence of errors, interruptions or temporary unavailability for technical, maintenance or force majeure reasons.

To the extent permitted by law, we are not liable for damages arising from misuse of the site, inaccurate data entered by users, or decisions taken solely on the basis of AI-generated answers. The specific rules for the chat are set out in the AI notice.

8. Data protection and cookies

Personal data processing is governed by the privacy policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Cookies are governed by the cookie policy.

9. Governing law and jurisdiction

This notice is governed by Spanish law. Disputes with consumers resident in Spain will be heard by the courts of the consumer's domicile; otherwise, by the courts of the owner's registered office, without prejudice to any mandatory rights.
